[Hvcatskillcewg] Conservation easement extinguishment

I've got a semi-fast moving and confidential topic for you all.  

We may be facing the partial extinguishment of a conservation easement in
Dutchess County.  A portion of the property could be taken by eminent
domain; we assume they would also pursue judicial proceedings to extinguish
the easement over that portion of the property.  The property has been
identified as a potential site for a sewage treatment facility.  The terms
of the easement do not permit this use or structure(s), do not allow us to
amend for this purpose, does not allow us to subdivide for this purpose.

Has anyone had to deal with full or partial extinguishment or heard of
anyone who has (in New York State)?
